1. What we provide
LMS Picks provides software that lets a football club run a Last Man Standing competition among its own members. We provide the software and hosting. We do not organise, promote, or run your competition.
2. Money and prizes
We never receive, hold, process or distribute entry fees or prize money. All money relating to your competition is collected, held and paid out by your club, directly between your club and its participants.
Your club is solely responsible for the lawfulness of its competition, including any applicable gambling, lottery, prize-competition, tax and consumer-protection requirements in your jurisdiction. If you are unsure whether your competition is lawful, take your own advice before running it.
3. Your account
You are responsible for keeping your admin credentials secure and for everything done through your account. Tell us promptly if you believe your account has been compromised.
You must not use the service to run a competition open to the general public rather than to your club's own members and associates, to run anything unlawful, or to attempt to access another club's data.
4. Participants' data
You decide which participants to add and what to record about them. In data-protection terms you are the controller of that information and we are your processor. You must have a lawful basis for adding someone and must tell participants how their information will be used. See our privacy policy.
5. Fees
Paid plans are billed in advance for the period shown at checkout, and renew automatically until cancelled. Payments are processed by Stripe; we never see or store your card details.
You can cancel at any time from your billing area. Cancellation takes effect at the end of the period you have paid for, and we do not refund part-periods except where required by law.
We may change our prices, giving at least 30 days' notice before the change applies to your renewal.
6. Availability
We work to keep the service available but do not guarantee uninterrupted access. Fixture and result data comes from a third-party provider, and we are not responsible for errors, delays or outages in that data. Verify results independently before paying out a prize.
7. Suspension and termination
We may suspend or terminate an account for non-payment, for breach of these terms, or where we reasonably believe the service is being used unlawfully. Where practical we will contact you first.
After cancellation, your competition data is retained for the period stated in our privacy policy and then permanently deleted. You can export your data before then.
8. Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, we are not liable for indirect or consequential loss, for lost profits or lost goodwill, or for any dispute between your club and its participants — including disputes about results, eliminations or prizes. Our total liability in any twelve-month period is limited to the fees you paid us in that period.
9. Changes
We may update these terms. Material changes will be notified by email to your account address at least 30 days beforehand.
10. Governing law
These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland have exclusive jurisdiction.
